fatal error with @mkdir

Subject: fatal error with @mkdir

it seems that several users have a problem with the ISP
we get a message like
Fatal error: mkdir(/mnt/124/ [<a href='function.mkdir'>function.mkdir</a>]: File exists in /mnt/124/ on line 180

This line 180 in io.php is
$locked = @mkdir($lockDir, $conf['dmode']);
and according to my limited knowledge, the @ shouldn't create a fatal error (no?)

Morover the command rmdir is not allowed by the server and the lock directories remain in the directory "lockdir".

For the time being, I have solved the problem by disabling the function io_lock(), but this is probably not a good idea.

Does somebody has an idea of the problem, or should it be treated like a bug ?
